FLRA Upholds NTEU Victory in CBP Representation Election
A final decision
was issued May 18 by the Federal Labor Relations Authority
(FLRA) upholding the validity of NTEU's overwhelming two-to-one
victory in last year's election to select a single union
to represent the CBP bargaining unit of some 21,000 employees.
The decision clears the way for NTEU to become the sole
representative of employees in CBP.
NTEU President Colleen M. Kelley applauded the FLRA decision.
"This is the beginning of an exciting new chapter in
the development of this key agency," Kelley said. NTEU
already represented some 14,000 CBP employees from the legacy
U.S. Customs Service.
In rejecting the final appeal of the losing union in that election, the three-member FLRA upheld a previous decision in favor of NTEU by that body's Washington Regional Director who earlier examined election complaints filed by the American Federation of Government Employees (AFGE). More

Do I have to revoke my current union membership
(AFGE or NAAE) to join NTEU or is it automatically transferred
to NTEU?
Your dues withholding with another union should
have been terminated automatically upon certification by
CBP. However, you will not be automatically “converted”
to NTEU membership from another union. Click

How do I join NTEU?
To join NTEU you must sign an 1187.
What is NTEU going to improve my workplace?
NTEU will soon begin negotiations for a new contract
with improvements for all employees when it comes to work
assignments, bid and rotation procedures, overtime and alternative
work schedules. In addition, NTEU is known for its hands

If I was formerly a member of another union and
have a pending grievance how will it be handled?
NTEU will assume responsibility for handling current
grievances, either under the existing agreements or under
the NTEU/CBP contract. If you have a grievance or potential
grievance, see your local NTEU steward.
I am a CBP Officer hired since July 2004. What
rights will I have now that NTEU has been named exclusive
representative?
Like other bargaining unit employees, they can
file grievances, and are entitled to union membership and
union representation.
If I was formerly a member of the Immigration or
Agriculture bargaining unit, what happens to my contract?
Working conditions including contractual arrangements
remain in effect. NTEU is moving quickly to seek application
of the NTEU/CBP contract to all bargaining unit employees.

I have health insurance or professional liability
insurance under my former union. Can I continue it?
It depends on arrangements your former union has
made. NTEU recommends that you contact your former union
and ask them.
